1. Acceptance of Terms
By accessing or using CBrowser ("the Service"), including the website at cbrowser.ai, the hosted SaaS platform, the npm package, API endpoints, documentation, and all related services, you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Alexandria Eden, sole proprietor ("we," "our," or "us").
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In that case, "you" and "your" refer to both you individually and the organization.
If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes acceptance of the updated Terms.
2. Description of Service
CBrowser is a cognitive browser automation platform providing 120+ MCP (Model Context Protocol) tools for browser automation, accessibility auditing, persona-based testing, visual regression analysis, and AI-friendliness evaluation. The Service includes:
- Browser automation tools with AI-powered element detection and interaction
- Cognitive persona testing that simulates real users with diverse abilities and contexts
- Accessibility auditing and compliance analysis (WCAG, ADA, Section 508)
- Visual regression testing, readability analysis, and competitive benchmarking
- MCP server integration for Claude Desktop and other AI assistants
- A hosted SaaS platform at cbrowser.ai with account management, credit billing, and API access
The Service is offered in two forms: (a) an open-source npm package licensed under the MIT License, and (b) a hosted SaaS platform at cbrowser.ai. These Terms govern the use of both, with certain provisions (including billing, credits, and account management) applying only to the hosted SaaS platform.
3. Account Registration and Responsibilities
3.1 Account Creation
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update that information as necessary to keep it accurate and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You agree to:
- Use strong, unique passwords for your account
- Never share your API keys publicly or embed them in client-side code
- Rotate API keys immediately if you suspect unauthorized access
- Notify us promptly of any unauthorized use of your account or any other security breach
You are fully responsible for all activities that occur under your account or API keys, whether or not you authorized them. We are not liable for any loss or damage arising from your failure to protect your credentials.
3.3 Age Requirement
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.
4. Acceptable Use
4.1 Permitted Uses
You may use the Service for lawful purposes, including but not limited to:
- Testing websites and applications that you own or have authorization to test
- Accessibility auditing and compliance analysis of your own properties
- Competitive analysis and benchmarking of publicly accessible websites
- User experience research and cognitive load analysis
- Quality assurance testing within your development workflow
- Generating reports, screenshots, and analytics for sites you are authorized to evaluate
4.2 Prohibited Uses
You may NOT use the Service to:
- Conduct unauthorized penetration testing or vulnerability scanning on systems you do not own or have written permission to test
- Execute or facilitate distributed denial-of-service (DDoS) attacks or any form of network disruption
- Perform credential stuffing, brute-force attacks, or automated login attempts against unauthorized targets
- Scrape, harvest, or collect private or personal data without authorization or in violation of applicable law
- Bypass, circumvent, or defeat authentication mechanisms, access controls, or security measures on systems you are not authorized to access
- Distribute malware, ransomware, spyware, or conduct phishing operations
- Engage in any activity that violates applicable local, state, national, or international law or regulation
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Resell, sublicense, or redistribute access to the Service without our written consent
- Use the Service to generate spam, unsolicited communications, or abusive content
4.3 Constitutional Safety Zones
CBrowser implements a Constitutional Safety framework that classifies operations into safety zones:
- GREEN β Safe operations: reading, screenshots, accessibility checks, standard navigation
- YELLOW β Cautioned operations: form interactions, file downloads, operations requiring domain authorization
- RED β Restricted operations: actions that modify state on third-party systems, bulk data operations, operations on sensitive pages
- BLACK β Prohibited operations: actions that could cause harm, violate law, or compromise security. These are blocked unconditionally
Attempting to bypass, disable, or circumvent the Constitutional Safety framework is a violation of these Terms and may result in immediate account termination.
5. Service Tiers, Credits, and Billing
5.1 Service Tiers
The Service is offered in the following tiers:
- Free β 38 tools, 50 credits per month, 1 registered domain
- Pro ($49.99/month) β 97 tools, 2,000 credits per month, 1 registered domain (additional domains at $20/month each)
- Enterprise (custom pricing) β 120+ tools, 10,000 credits per month, 10 registered domains, dedicated support
Feature availability, tool counts, and pricing are subject to change. We will provide reasonable notice before any changes take effect for active subscribers.
5.2 Credits
Credits are the unit of consumption for CBrowser tools. Each tool invocation costs credits based on the tool's complexity tier:
- Tier 1 (Basic) β 1 credit per invocation (e.g., navigation, screenshots)
- Tier 2 (Standard) β 2 credits per invocation (e.g., accessibility checks, element interaction)
- Tier 3 (Advanced) β 5 credits per invocation (e.g., cognitive journeys, persona testing)
- Tier 4 (Premium) β 10 credits per invocation (e.g., full-site audits, empathy audits)
5.3 Credit Rollover and Expiration
- Monthly subscription credits (Free tier): Do not roll over. Unused credits expire at the end of each billing cycle.
- Monthly subscription credits (Pro tier): Roll over for up to 60 days. Credits older than 60 days expire automatically.
- Monthly subscription credits (Enterprise tier): Rollover terms are defined in your Enterprise agreement.
- Bonus credits (earned through promotions, referrals, or rewards): Do not expire.
- Pay-as-you-go credits: Expire 12 months from the date of purchase.
5.4 Pay-As-You-Go Credit Packages
Additional credits may be purchased in the following packages:
- 100 credits β $9.99
- 500 credits β $34.99
- 1,000 credits β $59.99
5.5 Billing and Payment
Subscription fees are billed in advance on a monthly recurring basis. Pay-as-you-go credit purchases are billed at the time of purchase. All payments are processed through our third-party payment processor. You agree to provide valid payment information and authorize us to charge your payment method for all fees incurred.
5.6 Refunds
Used credits are non-refundable. If you cancel a subscription mid-cycle, you retain access to paid features and remaining credits through the end of the current billing period. No prorated refunds will be issued for partial billing periods. Refund requests for unused pay-as-you-go credit packages may be considered on a case-by-case basis within 14 days of purchase by contacting [email protected].
6. Domain Restrictions
Certain tools in the Service are scoped to your registered domains. You must register the domains you intend to use with CBrowser in your account settings. The number of domains you may register depends on your service tier.
- Free: 1 domain included
- Pro: 1 domain included; additional domains at $20/month each
- Enterprise: 10 domains included; additional domains per your agreement
You represent and warrant that you have the right to register each domain you add to your account and that you are authorized to perform automated testing on that domain. Some tools (such as public-site analysis tools classified as GREEN-zone operations) may function on non-registered domains where the operation is purely read-only and does not require authorization.
7. API Usage and Rate Limits
7.1 API Access
The Service provides API endpoints for programmatic access. You must authenticate all API requests using a valid API key associated with your account. API keys are confidential credentials and must not be shared, published, or embedded in publicly accessible code.
7.2 Rate Limits
API requests are subject to the following rate limits:
- Free: 100 requests per hour
- Pro: 1,000 requests per hour
- Enterprise: Unlimited (subject to fair use and infrastructure capacity)
Exceeding rate limits will result in HTTP 429 responses. Persistent or deliberate circumvention of rate limits may result in account suspension.
7.3 Public Tool Discovery
The tools/list endpoint is publicly accessible and does not count against rate limits. This endpoint enables MCP client discovery and integration.
8. Intellectual Property
8.1 Open Source Package
The CBrowser npm package is open-source software released under the MIT License. You may use, modify, and distribute the npm package in accordance with the MIT License terms. The source code is available at github.com/anthropics/cbrowser.
8.2 Hosted Service
The hosted SaaS platform at cbrowser.ai β including its infrastructure, APIs, account system, billing system, web application, and proprietary extensions β is proprietary. Nothing in these Terms grants you any right, title, or interest in the hosted platform beyond the limited right to use it in accordance with these Terms and your service tier.
8.3 Trademarks
The CBrowser name, logo, branding, and visual identity are the property of Alexandria Eden. You may not use our trademarks without prior written consent, except as reasonably necessary to identify the Service in connection with your authorized use (e.g., "Tested with CBrowser").
8.4 Your Content and Data
You retain all rights to data you submit to or generate through the Service. This includes your test configurations, report data, screenshots, analysis results, and any other output produced by CBrowser tools. We claim no ownership of your content.
By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you. We will not use your data for any other purpose without your consent.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, store, and protect your personal information. Please review the Privacy Policy carefully.
If you use the Service to process personal data of third parties (e.g., by automating interactions with sites that collect user data), you are solely responsible for ensuring compliance with all applicable data protection laws, including GDPR, CCPA, and any other relevant legislation.
10. Third-Party Services
The Service integrates with and depends on third-party services, including but not limited to:
- Anthropic (Claude API) β Powers AI-driven analysis, cognitive scoring, and persona simulation. Subject to Anthropic's Terms of Service.
- Playwright β Provides browser automation infrastructure
- Payment processors β Handle billing and payment card processing
We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of third-party services through CBrowser is subject to the respective third party's terms and conditions.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, we make no representations or warranties that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate, reliable, or complete
- Any defects in the Service will be corrected
- The Service will meet your specific requirements
Cognitive scores, accessibility assessments, persona simulation results, and other analytical outputs are generated by AI models and are intended as informational guidance. They do not constitute absolute measurements, professional auditing, or legal compliance certification. You should validate results independently and consult qualified professionals for compliance determinations.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALEXANDRIA EDEN, OR ANY OF HER AGENTS, PARTNERS, CONTRACTORS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Alexandria Eden and her officers, agents, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third party's rights, including intellectual property or privacy rights
- Your use of the Service to access, test, or interact with websites or systems without proper authorization
- Any content or data you submit to or generate through the Service
This indemnification obligation survives the termination of your account and these Terms.
14. Termination
14.1 Termination by You
You may delete your account at any time through your account settings. Upon account deletion, all of your data will be permanently and irrevocably deleted through a cascade deletion process. This includes your account information, API keys, usage history, registered domains, credit balances, and all stored results. This action cannot be undone.
14.2 Termination by Us
We reserve the right to suspend or terminate your account, with or without notice, if:
- You violate these Terms or any applicable law
- You engage in prohibited activities as described in Section 4
- You attempt to bypass Constitutional Safety protections
- Your use of the Service poses a security risk or could harm other users
- Your account has been inactive for more than 12 consecutive months (Free tier only)
- We are required to do so by law or regulation
14.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. Unused credits are forfeited upon termination for cause. If we terminate your account without cause, or if you delete your account mid-billing-cycle, you will retain access to paid features through the end of your current billing period. Sections 8, 11, 12, 13, 15, and 16 survive termination.
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal proceeding, you agree to attempt to resolve disputes informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within 30 days.
15.2 Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association. The arbitration shall be conducted in Colorado, USA. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
15.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, collective action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Provide notice via email to the address associated with your account, or by posting a prominent notice on the cbrowser.ai website
- For changes that materially affect paid subscribers, provide at least 30 days' notice before the changes take effect
Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must stop using the Service and delete your account.
18. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changes to features, tools, credit costs, rate limits, and tier structures. We will use reasonable efforts to notify active subscribers of material changes to the Service. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
19. Open Source Acknowledgment
The CBrowser npm package incorporates and depends on various open-source software components, each subject to their own license terms. A list of these components and their licenses is available in the package's repository. Nothing in these Terms restricts your rights under the applicable open-source licenses for those components.
If there is a conflict between the MIT License governing the open-source npm package and these Terms, the MIT License controls with respect to the npm package. These Terms control with respect to the hosted SaaS platform and any proprietary components.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with the Privacy Policy and any Enterprise agreements executed separately, constitute the entire agreement between you and us regarding the Service. These Terms supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.
22. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
23. Assignment
You may not assign or transfer these Terms or your rights under them, in whole or in part, without our prior written consent. We may assign these Terms at any time without restriction and without notice to you. Subject to the foregoing, these Terms bind and inure to the benefit of each party's successors and permitted assigns.
24. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, pandemics, or failures of third-party service providers.
